Privacy Policy

Bubblegum Embroidery is based in the USA and has been selling on Etsy since 2010.

This Privacy Policy describes how and when we collect, use, and share information when you purchase an item from us, contact us, or otherwise use our services through Etsy.com or its related sites and services. This Privacy Policy does not apply to the practices of third parties that we do not own or control, including Etsy or any third party services you access through Etsy.

Information We Collect:

We do not spam or advertise to our customers. We do not share or sell your information to anyone. Your information is only used by you when you place an order. Your privacy is important to us. To fulfill your order, you must provide us with certain information (which you authorized Etsy to provide to us), such as your name, email address, postal address, payment information, and the details of the product that you’re ordering. We cannot see your payment information as it is processed through the payment processing system you used when placing your order. We cannot see that information.

Why We Need Your Information and How We Use It:

We rely on a number of legal bases to collect, use, and share your information, including:
As needed to provide my services, such as when I use your information to fulfill your order, to settle disputes, or to provide customer support;
If necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law; and
as necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as 1) providing and improving my services. We use your information to provide the services you requested and in our legitimate interest to improve services; 2) Compliance with the Etsy Seller Policy and Terms of Use. We only use your information as necessary to comply with obligations under the Etsy Seller Policy and Terms of Use. We do not spam or advertise to our customers.

Information Sharing and Disclosure:

Information about my customers is important to my business. We share your personal information for very limited reasons and in limited circumstances, as follows:

Etsy. We share information with Etsy as necessary to provide you our services and comply with obligations under both the Etsy Seller Policy and Etsy Terms of Use. Remember, this Privacy Policy does not apply to the practices of third parties that we do not own or control, including Etsy or any third party services you access through Etsy.

*Service providers. If we have a need to ship tangible items, we engage certain trusted third parties to perform functions and provide services to my shop, such as delivery companies. We will share your personal information with these third parties, but only to the extent necessary to perform these services. This shop sells digital embroidery files and does not ship tangible items at this time.

Compliance with laws. We may collect, use, retain, and share your information if we have a good faith belief that it is reasonably necessary to (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.

Data Retention:

We retain your personal information only for as long as necessary to provide you with my services and as described in our Privacy Policy. However, we may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce our agreements.

If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases as described below:

Access. You may have the right to access and receive a copy of the personal information I hold about you by contacting us through your Etsy account.
Change, restrict, delete. You may also have rights to change, restrict our use of, or delete your personal information. Absent exceptional circumstances (like where I am required to store data for legal reasons) we will generally delete your personal information upon request.
We do not send out marketing materials to our customers.
Complain. If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.

How to Contact Us:
You may contact us through your Etsy account via the contact button. Please note, due to schedule demands outside of Etsy, all commissions are closed. We are not accepting custom requests. Do not use the contact feature for this purpose. Your patience is appreciated.

Please Note:
Digital file access.
Any orders placed from current dating back to September 2013, customers can still access the original file version (not updates) purchased during this time frame. Any orders prior have expired or is no longer accessible as it was a manual email. Check the email address you used when purchasing the digital design file for the exact file version you purchased prior to September 2013. You are responsible for storing your purchase in an easy to remember safe location on your data systems. You are also responsible for creating and keeping a back up of the purchase. Orders placed prior to this date are no longer retained by us and cannot be resent. Any orders placed after September 2013 will not be resent as it can be re-downloaded from your account. To do so, please log into your Etsy account, view your purchase history, and re-download your purchase.
